By checking the SMS consent box and submitting your phone number through our SMS signup form, you opt in to receive recurring text messages from Canopy Digital regarding new investment opportunities, account updates, and related informational content. Certain features of the Platform may be subject to fees, which will be disclosed to you before you incur them. By using a fee-based feature, you authorize TRENDIO to charge the applicable fees to your designated payment method. Fees are non-refundable except where required by law or expressly stated at the time of purchase. We reserve the right to change our fee structure with reasonable prior notice.
All content on the Platform, including but not limited to text, graphics, logos, educational materials, and underlying software, is the property of TRENDIO LLC or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for your personal, non-commercial use only. No other rights are granted.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TRENDIO DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY CONTENT, ILLUSTRATIVE FIGURE, OR REPORTING DATA WILL BE ACCURATE OR COMPLETE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRENDIO LLC AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, OR INVESTMENT VALUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO TRENDIO IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
We may suspend or terminate your access to the Platform at any time, with or without notice, if we reasonably believe you have violated these Terms. You may terminate your account at any time by contacting us or using the account controls provided on the Platform. Sections of these Terms that by their nature should survive termination will survive, including intellectual property, disclaimers, and limitation of liability provisions.
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.
We may update these Terms from time to time. If we make material changes, we will provide notice through the Platform or by other reasonable means. Your continued use of the Platform after such changes take effect constitutes your acceptance of the revised Terms.
